Mediation Process
Internal mediation process to deliver service:
- Enquires are screened to determine eligibility for mediation.
- All parties are contacted to agree to mediate.
- The parties agree on the mediator.
- Agreement to Mediate is signed by all parties to the dispute.
- Date, time and meeting rooms are booked.
Initially, parties in dispute are invited to negotiate their differences in the mediation process. If mediation is recommended and one party to the dispute is reluctant to engage the other party in the mediation process, the Mediation Services function is to inform that party of the value of negotiating their own settlements and to persuade the party to participate in mediation.
Generally, the reluctant parties are persuaded because there is evidence that mediation works. They learn that the structured negotiating process ensures the most effective and productive use of their time and money.
Mediation Services: handle the logistics of the mediation, explains the process and appoints a skilled mediator.
The process to resolve disputes is highly successful. Being prepared is essential.
Preparing for mediation
Preparation involves a summary of what happened, what is not working and the disputed issues. The disputants submit their brief story to the mediator. Although not required, those who prepare usually have less anxiety, more likely to settle at mediation and express satisfaction with the process.
